Terms of Service

By creating an account on followtodm.com, you agree to be bound by these Terms of Service (“Terms”). These Terms form a legally binding agreement between you and Faceleadz LTD (“Follow to DM”, “we”, “us”, “our”), a company incorporated in England and Wales.

If you do not agree to these Terms, you must not use the Service. Your continued use of the Service following any updates to these Terms constitutes acceptance of the revised Terms.

• “Service” means the Follow to DM platform accessible at followtodm.com and all related features.
• “Customer” / “you” means any individual or entity that registers for and uses the Service.
• “Instagram Account” means the Instagram profile you connect to the Service.
• “DM” means a direct message sent via Instagram’s messaging system.
• “Subscription” means your paid or trial access to the Service.
• “Content” means any text, messages, or other material you configure or upload through the Service.

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into this agreement.

If you are subscribing on behalf of a company or organisation, you confirm that you have the authority to bind that entity to these Terms, and that the entity accepts these Terms in full.

You must provide accurate, current, and complete information when creating your account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must notify us immediately of any unauthorised access to or use of your account at contact@followtodm.com. We are not liable for any loss or damage resulting from your failure to protect your account credentials.

To use the Service, you must connect your Instagram account by providing your Instagram session credentials. By doing so, you acknowledge and expressly agree to the following:

• Instagram may restrict, suspend, or permanently ban your Instagram account as a result of your use of the Service, at any time and at their sole discretion.
• Follow to DM has no control over, and assumes no responsibility for, any action Instagram may take against your account.
• You are solely responsible for ensuring your use of the Service is compliant with Instagram’s terms and any applicable laws.
• By connecting your Instagram account, you expressly accept these risks and release Follow to DM from any and all liability arising from any action taken by Instagram against your account or content.
• You warrant that you have full authority to connect and authorise the automation of the Instagram account you link to the Service.

The Service is offered on a monthly subscription basis. Your subscription begins on the date you subscribe and renews automatically each month on the same date, unless cancelled before the renewal date.

By subscribing, you authorise Follow to DM to charge your payment method on a recurring monthly basis via Stripe. You must provide accurate and complete billing information. If your payment fails, we reserve the right to suspend or terminate your access to the Service.

We reserve the right to change subscription fees at any time. You will be given advance notice of any price change and the option to cancel your subscription before the new price takes effect. Continued use of the Service after a price change constitutes your acceptance of the new fee.

We reserve the right to take any lawful action to recover past-due subscription fees, including suspension of access. Suspension does not relieve you of any outstanding payment obligations.

New customers may be eligible for a 5-day free trial. Only one free trial per person or legal entity is permitted. At the end of the trial period, your subscription will automatically convert to a paid monthly subscription unless you cancel before the trial ends.

We reserve the right to withdraw or modify the free trial offer at any time without notice.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period, and you will retain access to the Service until that date. To avoid being charged for the next billing period, you must cancel before your renewal date.

Your subscription may be cancelled or renewed at any time through your account settings. Following cancellation, your subscription may be reactivated at any time.

You may use the Service only in compliance with these Terms, all applicable laws and regulations, and Instagram’s own Terms of Use and Community Guidelines. We strongly recommend you read and familiarise yourself with Instagram’s policies before using the Service.

You must not use the Service to send messages or Content that:

• Infringes the intellectual property, privacy, or other rights of any third party;
• Is threatening, harassing, abusive, defamatory, obscene, or unlawful;
• Contains spam, unsolicited commercial messages, phishing, or deceptive content;
• Targets, collects data from, or is directed at minors under the age of 18;
• Impersonates any person, entity, or brand, or misrepresents your affiliation with another;
• Contains malware, viruses, or any harmful or disruptive code;
• Violates any applicable anti-spam, data protection, or consumer protection legislation.

We reserve the right to suspend or permanently terminate your account, without notice or refund, if we determine that you have violated these Terms, applicable law, or Instagram’s terms.

All intellectual property rights in the Service — including software, design, trademarks, and content — are owned by or licensed to Faceleadz LTD. You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service solely during your active Subscription and in accordance with these Terms.

You must not copy, modify, reverse-engineer, distribute, sublicense, or create derivative works from any part of the Service without our prior written consent.

You retain all rights to the Content you create and upload through the Service. By using the Service, you grant us a limited licence to process and use your Content solely to the extent necessary to provide the Service to you.

The Service integrates with third-party platforms, including Instagram (Meta Platforms, Inc.) and Stripe, Inc. for payment processing. We are not responsible for the availability, accuracy, security, or actions of any third-party service.

Your use of these third-party services is governed solely by their respective terms of service and privacy policies. We encourage you to review these policies independently.

The Service is provided “as is” and “as available” without any warranties of any kind, express or implied. To the fullest extent permitted by law, Follow to DM disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that any particular result will be achieved. We are not affiliated with, endorsed by, or in any way officially connected with Instagram or Meta Platforms, Inc.

We will endeavour to notify users in advance of planned maintenance. We accept no liability for unplanned downtime or service interruptions.

To the fullest extent permitted by applicable law, Faceleadz LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, revenue, goodwill, business opportunity, or account access, arising out of or in connection with your use of the Service.

Our total aggregate liability to you for any claims arising under or in connection with these Terms shall not exceed the total subscription fees you paid to us in the three (3) months preceding the event giving rise to the claim.

Your sole remedy for any dissatisfaction with the Service or breach of these Terms is to cancel your subscription and discontinue use of the Service.

You agree to indemnify, defend, and hold harmless Faceleadz LTD and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of the Service;
• Your violation of these Terms or any applicable law;
• Any Content you send through the Service; or
• Your infringement of any rights of a third party.

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, any applicable law, or for any other reason at our sole discretion. No refund will be issued upon termination for cause.

Upon termination of your account for any reason, all rights and licences granted to you under these Terms will immediately cease. Provisions of these Terms that by their nature should survive termination — including limitations of liability, indemnification, and governing law — shall survive.

These Terms and any dispute arising out of or in connection with them are governed by the laws of England and Wales. Subject to any mandatory consumer rights in your jurisdiction, you agree to submit to the exclusive jurisdiction of the courts of England and Wales.

We reserve the right to modify these Terms at any time. We will provide advance notice of any material changes — typically by email or by posting a notice on the platform. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.

If you do not agree with any updated Terms, you must stop using the Service and cancel your subscription before the changes take effect.

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions of these Terms will continue in full force and effect.
